Use this sequence when filing a provisional application.

  • Finalize specification draft and figures (if needed for understanding).
  • Confirm inventor names/order and applicant/assignee details.
  • Confirm entity status eligibility: Large, Small, or Micro.
  • Prepare core submission set: specification, drawings (if any), cover/transmittal data, and payment details.
  • Create and validate a provisional submission in USPTO Patent Center.
  • Upload files, verify readability, and submit with fee payment.
  • Save filing confirmation package: receipt, payment proof, application number, and submission timestamp.

Utility Filing Checklist

Use this sequence when filing a nonprovisional utility application.

  • Lock final claim set and written-description support.
  • Finalize formal drawing set and caption mapping.
  • Confirm inventorship, assignment posture, and entity status.
  • Prepare submission set: specification, claims, abstract, drawings, oath/declaration, and application data sheet.
  • Validate fee lines in Patent Center (filing, search, examination, and any excess-claim/size fees).
  • Submit, pay, and preserve confirmation artifacts.
  • Create post-filing docket for due dates and missing-part windows.

Fee Readiness

Complete before opening payment in Patent Center.

  • Verify current fees in USPTO Patent Center at filing time.
  • Pre-validate payment method: card, ACH/EFT, or USPTO deposit account.
  • Confirm entity status before payment; fee impact is material.
  • Archive payment receipt with the filing record immediately after submit.

Online and Shipping Options

Online is preferred; shipping is fallback-only.

  • Use online filing first whenever possible; it is preferred for timestamp and confirmation integrity.
  • If paper filing is unavoidable, use tracked courier with signed delivery proof.
  • Use the current USPTO paper/courier address from USPTO the same day you ship.
  • Include full transmittal/payment instructions and keep shipment evidence.
